SendMode Terms of Service

1. Agreement

These Terms of Service ("Terms") are a contract between you and Time Chamber Studios, the maker and operator of SendMode ("SendMode," "we," "us"), governing your use of the SendMode app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use SendMode

You must be at least 13 years old (or the minimum age of digital consent in your country) to use SendMode. By using the Service you represent that you meet this requirement and that the information you provide is accurate.

3. Your account

You are responsible for the activity on your account and for keeping your sign-in secure. You sign in with Sign in with Apple. Tell us promptly at support@timechamberstudios.com if you believe your account has been compromised.

4. Health, fitness, and safety — important

SendMode is a fitness and entertainment app, not a medical device and not a source of medical advice. It does not diagnose, treat, cure, or prevent any condition. Watts, streaks, achievements, and leaderboards are game mechanics, not health recommendations.

Always consult a qualified healthcare professional before beginning or changing an exercise program. Do not disregard professional medical advice or delay seeking it because of anything in the app. You exercise at your own risk, and you are solely responsible for training within your limits. If you experience pain, dizziness, or other warning signs, stop and seek medical attention.

5. Watts and the in-app economy

• Watts (⚡) have no monetary value. They cannot be purchased with real money, exchanged for cash, transferred between accounts, or redeemed for anything outside the app. They are earned only through recorded physical activity.
• Cosmetic items and Send Packs are obtained with watts (or as free grants) and are purely cosmetic. They confer no competitive advantage and no real-world value.
• Send Packs are a game feature, not gambling. Drop odds and pity thresholds are published in the app, and packs are never purchasable with real money.
• We may adjust the economy — earning rates, prices, drop rates, item availability, and seasonal content — as part of normal live operation. We will not do so in a way that removes items you have already earned, except as needed for security, legal, or technical reasons.
• We do not tolerate cheating, including submitting fabricated or falsified workouts to earn watts. We may reverse watts, remove items, or suspend accounts that do so.

6. Your content and data

You retain ownership of the workout and profile data you provide. You grant us a limited license to store, process, and display it as needed to operate the Service (for example, showing your username and rank on a leaderboard), as described in our Privacy Policy. You are responsible for the content you submit (such as your username) and must not submit anything unlawful, infringing, or offensive.

7. Acceptable use

You agree not to:

• reverse engineer, tamper with, or abuse the Service or its APIs;
• submit false, fabricated, or automated workout data;
• attempt to gain unauthorized access to accounts, data, or systems;
• disrupt the Service or other users' use of it;
• harass, threaten, impersonate, or spam other players, including through your username, follows, or reports;
• use the Service to violate any law or the rights of others.

We do not tolerate objectionable content or abusive behaviour. You can block any player and report them from their profile card; we aim to review reports within 24 hours and may rename, remove from the beta, suspend, or terminate accounts that violate these Terms.

8. Third-party services

If we offer a connection to a third-party service (for example a fitness platform) and you use it, your use of that service is governed by that service's own terms and privacy policy. We are not responsible for third-party services, and their availability may change (for example, a provider may change its API terms).

9. Changes to the Service

We are actively developing SendMode. We may add, change, or remove features, and we may suspend or discontinue the Service (or parts of it) at any time. We will try to give reasonable notice of significant changes where practical.

10. Termination

You may stop using SendMode and delete your account at any time from Profile → Delete Account. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users. Sections that by their nature should survive termination (including Sections 4, 5, 11, 12, and 13) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or accurate, or that data (including watts totals or imported workouts) will always be complete or correct.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SENDMODE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED [the greater of USD $50 or the amount you paid us in the 12 months before the claim]. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws rules. Any dispute arising out of these Terms or the Service that we cannot resolve informally will be brought in the state or federal courts located in Washington, and both sides consent to their jurisdiction and venue. Nothing in these Terms limits rights you have that cannot be waived under the mandatory law of your country of residence.

14. Apple App Store terms

If you downloaded SendMode from the Apple App Store, you acknowledge that these Terms are between you and SendMode only, not Apple; that Apple has no obligation to provide support for the app; and that Apple is a third-party beneficiary of these Terms entitled to enforce them. You represent that you are not located in a country subject to a US Government embargo or on any US Government restricted-party list.

15. Miscellaneous

These Terms are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
